A special election is hereby ordered to be held on November 5, 2024, pursuant to Texas Tax Code sections 26.05 and 26.08 to approve the 2024 ad valorem tax rate for the Magnolia Independent School District because the adopted rate exceeds the Magnolia ISD Voter-Approval Tax Rate.
Ratifying the Ad Valorem Tax Rate of $0.9895 in Magnolia Independent School District for the current year, a rate that will result in an increase of 5 percent in maintenance and operation tax revenue for the district for the preceding year, which is an additional $3,700,978.

Bear Branch Elementary
Electioneering at Bear Branch Elementary School
Bear Branch Elementary School located at 8909 FM 1488, Magnolia, TX 77354 is a designated polling place under Texas Election Code 63.001, and shall hereafter be referred to as “Polling Place”. As such, both voters and electioneers are statutorily and constitutionally protected. Voters are protected by the prohibition of electioneering within 100 feet of an outside door through which a voter may enter the Polling Place (See 63.001 [a]). Electioneers are protected because the Polling Place may not, at any time during the voting period, prohibit electioneering on the Polling Place’s premises outside of the 100 foot prohibited area (See 63.001 [a-1]).
The Polling Place has identified the following potential public safety concerns with electioneering on its premises:
a. Obstructing the view of vehicles entering and exiting the premises at 8909 FM 1488, Magnolia, TX 77354;
b. Auto-pedestrian collision at the entrance to the Polling Place.
To address these concerns, the Polling Place implements the following reasonable restrictions per 63.001(a-1):
a. Electioneering will only be permitted on the Polling Place’s premises beyond the 100 foot prohibition of any outside door to the Polling Place building;
b. No electioneering will be permitted in the roadway of the Polling Place entry or exit;
c. No electioneering outside of the voting period defined Texas Election Code 63.001 (b)(2).
d. No political signage taller than 3 feet (including the stakes) will be permitted within the tree line or 8909 FM 1488, Magnolia, TX 77354 entry way;
e. Electioneers are prohibited from parking at any parking space within 100 feet of any entry door to the Polling Place building;
f. No vehicles or trailers shall be allowed on any grassed areas of the Polling Place’s premises or in any place not marked or designated as a parking spot;
g. And any other action in violation of the Texas Election Code or Texas Statutes is strictly prohibited.
In addition to potential criminal penalty, any electioneer who violates, neglects, or refuses to comply with the above-mentioned regulations may be removed by law enforcement personnel.

Electioneering at Lyon Elementary School
Lyon Elementary School located at 27035 Nichols Sawmill Road, Magnolia, TX 77355 is a designated polling place under Texas Election Code 63.001, and shall hereafter be referred to as “Polling Place”. As such, both voters and electioneers are statutorily and constitutionally protected. Voters are protected by the prohibition of electioneering within 100 feet of an outside door through which a voter may enter the Polling Place (See 63.001 [a]). Electioneers are protected because the Polling Place may not, at any time during the voting period, prohibit electioneering on the Polling Place’s premises outside of the 100 foot prohibited area (See 63.001 [a-1]).

Voters are protected by the prohibition of electioneering within 100 feet of an outside door through which a voter may enter the Polling Place (See 63.001 [a]). Electioneers are protected because the Polling Place may not, at any time during the voting period, prohibit electioneering on the Polling Place’s premises outside of the 100 foot prohibited area (See 63.001 [a-1]).

As such, both voters and electioneers are statutorily and constitutionally protected. Voters are protected by the prohibition of electioneering within 100 feet of an outside door through which a voter may enter the Polling Place (See 63.001 [a]). Electioneers are protected because the Polling Place may not, at any time during the voting period, prohibit electioneering on the Polling Place’s premises outside of the 100 foot prohibited area (See 63.001 [a-1]).
The Polling Place has identified the following potential public safety concerns with electioneering on its premises:
a. Obstructing the view of vehicles entering and exiting the premises at 42202 FM 1774, Magnolia, TX 77355;
b. Auto-pedestrian collision at the entrance to the Polling Place.
To address these concerns, the Polling Place implements the following reasonable restrictions per 63.001(a-1):
a. Electioneering will only be permitted on the Polling Place’s premises beyond the 100 foot prohibition of any outside door to the Polling Place building;
b. No electioneering will be permitted in the roadway of the Polling Place entry or exit;
c. No electioneering outside of the voting period defined Texas Election Code 63.001 (b)(2).
d. No political signage taller than 3 feet (including the stakes) will be permitted within the tree line, the drive from the entryway to the security booth, at the intersection where the security booth is located, or 42202 FM 1774, Magnolia, TX 77355 entry way;
e. Electioneers are prohibited from parking at any parking space within 100 feet of any entry door to the Polling Place building;
f. No vehicles or trailers shall be allowed on any grassed areas of the Polling Place’s premises or in any place not marked or designated as a parking spot;
g. And any other action in violation of the Texas Election Code or Texas Statutes is strictly prohibited.

As such, both voters and electioneers are statutorily and constitutionally protected. Voters are protected by the prohibition of electioneering within 100 feet of an outside door through which a voter may enter the Polling Place (See 63.001 [a]). Electioneers are protected because the Polling Place may not, at any time during the voting period, prohibit electioneering on the Polling Place’s premises outside of the 100 foot prohibited area (See 63.001 [a-1]).
